Hi bbover3,
----------------------------------------I understand the policy. However if that is the case, how can it then be that you use BOINC, which is not IBM developed either, or IBM property. I assume that is OK because for that there is a proper GPL license or so. If that is the solution for that then if Didactylos is willing we could find a similar solution by him providing the new logo's under a suitable license, or possibly even him selling them to you for a symbolic price? Trust me, it wasn't easy to get on BOINC. Hundreds of hours were spent with attorney's reviewing licenses etc. But in the long run it was better than sending millions of dollars to United Devices. And we are VERY satisfied with BOINC.
Now this badge thing has been floating around since July 24, 2004. It think it's time to let it go. I thought back then that Didactylos did an excellent job and told him that due to the external license hoopla, we were not in a position to use them. I also told Didactylos that I was not going to go to an attorney because the first thing an attorney would notice is that someone copied and modifying something that was created by IBM people. And that it was done without prior permission. You can see the problem that this would cause. Here's what I suggest.... In 2010 we'll probably add one or two more badges. Between now and then we'll think of a way to resolve the legal concerns. If the legal concerns are resolved, then in advance of doing any work, we'll let the CA's know if anyone wants to design the new badges. And we'll go from there. We already know what the next colors will be so no advance work is necessary. ![]() |

The images on the badges are nearly all stock photos. As such, they are not owned by IBM. In fact, I found them all with Google image search. The other images are owned by the respective projects.
So, there is no legal concern here. |

So, there is no legal concern here. They are not photos, they are graphics. If IBM does not own them they are careful enough not to use them. Because IBM does not own them, there is plenty of legal concern. Seems obvious to me...
